1. General
I. These are our Tariff Terms for enterprise and business customers effective from 1 October 2018. They‘ll apply to you if you have signed up to one of these tariffs, upgraded your phone and signed up for a new Minimum Term or changed the tariff you're on (or elements of it) at any time on or after 1 October 2018. If you haven’t done one of these things, the Tariff Terms when you signed up, last upgraded or changed your tariff will still apply until you do or until we contact you to tell you otherwise. These terms are in addition to your Business Contract, which can be found at Business terms and conditions ("Business Contract").
II. In these terms, "you" means you the Customer, and "your" shall be interpreted accordingly, while "we", "our", "us" or "O2" means Telefónica UK Ltd.
III. These terms relate to the following business tariffs (the "Tariffs"):
• Big Business Unlimited
• Big Business Unlimited Extra
• Big Business Just Data
• Big Business Pay as you use
• Big Business Pay as you use Extra and
• Best for Business
IV. It includes tariffs with the following inclusive data variants 0GB, 1GB, 2GB, 3GB, 5GB, 10GB, 20GB as well as shared data from 5GB up to 9TB.
V. Connection to any of the Tariffs may be subject to status, credit-check, fraud check and the terms of a 24 month Minimum Period (as defined in your Business Contract).
VI. Unless otherwise stated, call prices exclude VAT, are quoted by the minute, and after the first minute are charged in one second increments. Each call is charged excluding VAT and then rounded up to the nearest penny.
VII. In addition to the terms of your Business Contract, for Equipment supplied from 1 October 2018 with one of the Tariffs we warrant that the Equipment will conform in all material respects to the manufacturer’s specification from the date on which it is dispatched to you for 12 months or for the duration of your Minimum Period, whichever is longer, up to a total maximum warranty period of 24 months (but in the case of software 90 days). Some Equipment, including the Apple iPhone, is expressly excluded from this extended warranty period.
VIII. To access O2's data services your mobile device must be data compatible and enabled. Access to data services is subject to network coverage.
IX. Prices are correct at time of going to print but are subject to change.
X. Customers taking E Care and E Billing plans must maintain an email account.
XI. You may only use our services in our Europe Zone for periodic travel, like holidays, business trips or short breaks. If you’re not genuinely using our services for period travel we may have to charge you for, or suspend you from, using our services in our Europe Zone.

XIII. Big Business Unlimited and Big Business Unlimited Extra include unlimited calls and texts to mobiles numbers in our Europe Zone. See section 2 for details. A Fair Usage Policy applies. See section 8.

XV. Big Business Pay as you Use and Extra and Best for Business have no inclusive minutes or texts, every call made is charged at the tariffs pence per minute rate according to call type. Big Business Pay as you Use Extra includes Mobile Extension functionality. Further information can be found using the link in XII above.
XVI. The minimum call charge is equal to the per minute cost of each call. Exceptions apply to international calls to countries outside of our Europe Zone (excluding UK).
XVII. O2 may charge more for calls or suspend the service if O2 reasonably believes that the service is being used for call forwarding services, onward calling services, numbers that pay a revenue share or premium rate, directory enquiries numbers where special charges apply or if the service is being used contrary to our Fair Usage Policy.

XIX. Itemised paper billing is not included as standard. An itemised breakdown of calls can be viewed for no charge online by registering for O2’s My O2 Account website at My O2 Business. Alternatively you can pay to receive an itemised paper bill at an additional cost of £1.00 per month, per customer.
XX. We sometimes receive the details of Charges from another network late. Any late Charges which relate to a previous billing month will be highlighted on your bill.
XXI. Customers who wish to pay by payment methods other than Direct Debit will be charged a Direct Debit Opt Out charge of £2.50 per month.
XXII. Spend Caps
a. If you are a new or upgrading customer on or after 1 October 2018 and subscribing to an eligible tariff, you can apply a Spend Cap to your bill to help control your spend on out of bundle charges. Any chargeable usage outside of your monthly allowance or outside of any Bolt On allowance will count towards your Spend Cap. Once you use up your Spend Cap any additional chargeable usage will be barred.
Spend Caps are not available on Best for Business PAYU, Mobex, tariffs with shared minutes or shared data tariffs.
b. You can set your Spend Cap at £0, £5, £10, £15, £20, £30, £50, £75, £100 and £200.
c. The Spend Cap includes any chargeable usage outside of your monthly allowance or outside of any Bolt On allowances such as:
i. additional calls, texts and data usage when your standard bundle or Bolt On allowance has run out;
ii. calling and texting non-geographical or premium rate numbers aside from those premium rate numbers used for charitable donations which sit outside your Spend Cap, as set out below;
iii. calling and texting any international number from the UK;
iv. calling and texting any number outside of our Europe Zone (excluding the UK) when you are in our Europe Zone;
v. calling, texting and using data when you are in a country which is outside of our Europe Zone (excluding the UK);
vi. calling directory enquiry services; and
vii. the charge you pay to O2 for accessing any third party services.
d. The following Charges do not count towards your Spend Cap:
i. recurring charges towards your Airtime Plan, Device Plan, and insurance;
ii. any Bolt On charges which you opt-in to;
iii. any charitable donations made from your phone;
iv. charge to Mobile such as buying digital contents and apps from your phone;
v. any charges relating to the management of your account which includes but is not limited to paper bills, itemised paper bills and late payment fees; and

XXII. Auto – Switch
From 1 July 2019 you will be able to switch up to 24 connections to another provider by calling us, using a free text service (available for switching of 1 connection only), via webchat, via your My O2 Business Account or by sending us an email. We will then send you your PAC or STAC and Switching Information related to the numbers that you would like to switch.
If you decide to switch, the 30 days’ notice period will not apply and you will be able to switch as soon as you use your PAC or STAC.
Please note that you will still have to pay Termination Fee in accordance with your agreement and Auto Switch does not apply if you would like to switch more than 25 connections.
STAC means Switching Termination Authorisation Code provided to you by O2 if you request to switch but not to retain your existing number.
PAC means Porting Authorisation Code provided to you by O2 if you request to switch and retain your existing number.

2. Minutes and Call Charges - Applies to Big Business Unlimited & Big Business Unlimited Extra
Inclusive minutes on Tariffs that can be used for calls made:
a. in the UK to standard UK landlines (starting 01, 02 or 03);
b. in the UK to numbers allocated to UK mobile network operators that provide mobile services with substantial national coverage, all provided that O2 may exclude from your inclusive minutes allowance calls made to any number ranges which O2 reasonably believes are being used for call forwarding services, onward calling services or numbers that pay a revenue share. All Tariffs include access to voicemail menus and voicemail retrieval at no extra charge. Calls to voicemail 901 are not decremented from your inclusive allowance. Calls to selected telephone help lines are also free of charge and not decremented from your inclusive allowance; and c. to standard landline and mobile numbers within our Europe Zone and from our Europe Zone to the UK.
II. Inclusive minutes cannot be used for calls made:
a. from the UK to abroad,
b. from outside of our Europe Zone (excluding the UK) to abroad,
c.from our Europe Zone to countries outside our Europe Zone (excluding the UK).
d. in the UK and in our Europe Zone to:
i. non-geographic numbers (starting 05) which are charged at 37p per minute access plus a variable service charge;
ii. non-geographic numbers starting 080, which are free of charge;
iii. non-geographic numbers starting 084/087/118/09, which are subject to an O2 Business access charge of 37p per minute* access plus a variable service charge.
iv. non-standard 07 numbers (all those 07 numbers that are not specifically included in your inclusive minutes) which are charged at 21.28p per minute.
v. 07 and 01 numbers in Channel Islands and Isle of Man numbers, which are charged at 33p per minute and 070 numbers which are charged at 42.55p per minute.
*The service charge element of call charge is dependent on the number dialled.

3. Messages and Message Charges
I. Inclusive messages on the Tariffs can be used for texts sent within the UK, within our Europe Zone and from our Europe Zone to the UK.
II. Inclusive messages on the Tariffs cannot be used for:
a. premium rate messages where special charges apply,
b. sending texts from the UK to international numbers
c. sending texts from our Europe Zone to numbers outside of our Europe Zone (other than the UK);
d. sending texts from countries outside of our Europe Zone; (including Channel Islands and the Isle of Man);
e. picture or video messages (subject to having a compatible handset); or
f. any chargeable messages you receive.

IV. Any picture messages or video messages sent to numbers in the UK and in our Europe Zone will be charged at 21.28p per message. Any text messages sent whilst outside of the UK and our Europe Zone will be charged at standard roaming text rates.

VI. Our 'Unlimited' tariffs can for example, allow you to make unlimited calls to numbers of the type that make up your inclusive allowance. Any unlimited allowance must be for business, private or personal use. Our Fair Usage Policy applies - see Section 8.
4. Data Charges for non-data subscribers
I. Any data usage in the UK and in our Europe Zone will be charged at 2.5p per MB.
II. Data usage is measured in kilobytes (KB). 1MB = 1024 Kilobytes (KB), 1024 MB = 1 Gigabyte (GB). Data usage will be rounded to the nearest kilobyte and charges are rounded up to the nearest 1p. You are billed for the amount of data that travels over the data network. Please note that your bill may include charges for re-sent data packets and packets added to control the flow of data over the network.

5. Data Allowance Terms
I. Adding a Data Allowance allows you to use our data network via your mobile phone (internet capable and/or Wi-Fi accredited phones only). The Data Allowance includes a specified monthly data allowance.
II. The Tariffs are available in either capped or uncapped data variants.
If you choose a capped version and exceed your monthly Data Allowance we will impose network protection controls which may reduce your speed.
III. If you choose an uncapped version, we will impose out of bundle data charges of 2.5p per MB on any additional data you use.
IV. There are restrictions around how you can use your SIM card. See our Fair Usage Policy and Section 8 for more details.
V. If your mobile phone supports internet-tethering then this will be included in your data Bolt On and internet-tethering usage will be part of your monthly data allowance.
VI. We reserve the right to use appropriate traffic-shaping, charges or throttling measures to protect our network from types of data usage which we think might impact on levels of service for customers at specific times of day and/or in specific locations.
6. Big Business Just Data
I. These tariffs are Data Only to be used in the UK and in our Europe Zone and cannot be used for voice calls. They are available for individual users only in variants between 1GB and 20GB both capped and uncapped.
II. Uncapped variants are subject to the following terms:
i. Data usage outside of the data bundle/bolt on allowance of your chosen tariff will be charged at 2.5p per MB.
ii. Data usage is measured in megabytes (MB). 1MB = 1024 Kilobytes (KB), 1024 MB = 1 Gigabyte (GB).
iii. Data usage outside the data bundle/bolt on is rounded to the nearest kilobyte on a daily basis and charges are rounded up to the nearest 1p.
iv. These terms are supplementary to the terms of your chosen business tariff.
VII. Capped variants: If you choose a capped version and you exceed your monthly Data Allowance, we will impose network protection controls which may reduce your speed.
7. Shared Data
I. All the Tariffs are available with Shared Data and can be used in the UK and in our Europe Zone. The Shared Data is available between 5GB and 9TB. The data can be shared between 2 and 50,000 users.
II. The monthly cost of the Shared Data allowance will be allocated to one nominated SIM card. Each additional SIM card sharing that data will pay a monthly access fee of £2.00 in addition to the monthly cost.
III. The data will be used on a first come, first serve basis by all users sharing the allowance. Any unused inclusive minutes rollover until the next month only
IV. If you use more than your data monthly data allowance, additional data will be charged at 2.5 per MB, unless stated otherwise
8. Shared Roamed Data Bolt On
I. A fair usage policy operates ("Fair Usage Policy") operates and no customer may use their Equipment and/or service contrary to the rules of this policy. See https://www.o2.co.uk/termsandconditions/business/o2-business-fair-usage-policy-2018
II. You may not use your SIM Card:
a. in, or connected to, any phone other than the one which it was supplied with or the type intended by us for use with (For example a mobile phone Big Business Unlimited tariff SIM Card is intended for use in a mobile phone not a modem. This includes putting your SIM Card into a modem, modem usage or internet tethering on your device unless stated); or
b. in such a way that we reasonably believe adversely impacts the service to our other customers.
III. If we reasonably suspect you’re not behaving within this policy, we reserve the right to impose further charges or disconnect your SIM Card or your tariff at any time, having attempted to contact you first. We may need to manage traffic to protect our network.
