Contract Buyout and Handset Voucher Offer
RPI rate is Retail Price Index rate of inflation announced in February each year.
These terms and conditions (the “Terms”) govern the Offers as described below. Please read them carefully.
Defined Terms
1.1. "Offers" means the Contract Buyout Offer and Handset Voucher Offer, each as defined below.
1.2. “Outstanding Balance” means payments or balance due relating to the device plan on your old contract.
1.3. "Promoter” means Telefonica UK Limited, 500 Brook Drive, Reading, RG2 6UU, trading as O2, also referred to as "we” and “us”.
1.4. “Qualifying Contract” means new O2 contract purchased directly from O2, which consists of a Device Plan consumer credit agreement (see full terms at http://www.o2.co.uk/termsandconditions/mobile/o2-refresh-device-plan-cca-term-and-conditions together with an Airtime Plan, excluding any Bolt Ons or additional services, and before any other offer discounts have been applied.
Other important terms
2.1. The Offers are personal to you and cannot be transferred, unless otherwise permitted by the Promoter. The Offers cannot be exchanged for cash or other alternatives.
2.2. Responsibility is not accepted by us for Qualifying Contract applications that are damaged, lost, or delayed as a result of any computer hardware, network or software failure of any kind which may result in you being unable to participate in the Offers.
2.3. If you decide to cancel your Qualifying Contract, you are not entitled to refund on your Outstanding Balance, nor will you be able to go back onto your old contract.
2.4. If you cancel either your old contract or your Qualifying Contract, you'll still be responsible for any usage charges you've incurred. Please see the Pay Monthly Service Terms that come with your respective contract for more details.
2.5. These Offers cannot be used in conjunction with any other early upgrade offers or discounts for which you may also be eligible.
2.6. We may withdraw or amend the terms of this Offer at any time, details of which will be posted on o2.co.uk. Please check o2.co.uk for up-to-date information.
2.7. We will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with these Offers or accepting the Offers, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
2.8. By participating in the Offers, you will be deemed to have accepted and be bound by these terms. These terms prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials.
2.9. These terms and conditions shall be governed by English law and the English courts shall have exclusive jurisdiction.
Eligibility & Participation
3.1. To participate, you must upgrade to a Qualifying Contract. Eligible customers who upgrade to a Qualifying Contract can (i) get the Outstanding Balance on an eligible old contract cleared (the “Contract Buyout Offer”), and/or (ii) redeem their voucher code to get the voucher value (the “Handset Voucher Offer”) off the upfront cost of their Device Plan when purchasing a new O2 Refresh tariff directly from O2.
3.2. You must purchase a Qualifying Contract online at o2.co.uk, through our O2 telesales team or MyO2. New contracts that are not on O2 Refresh do not qualify.
3.3. The Contract Buyout Offer is only available upon invitation by the Promoter to O2 Pay Monthly customers on selected tariffs, who are within their minimum period and have an Outstanding Balance on their old contact.
3.4. The Handset Voucher Offer is only available upon invitation by the Promoter for O2 Pay Monthly customers upgrading to a qualifying Device Plan on O2 Refresh.
3.5. Participation is subject to status and credit checks.
3.6. There is only one Contract Buyout Offer per Qualifying Contract. The end date for the Contract Buyout Offer, if any, is as set out in your email or SMS after which it will expire. Once eligible customers have participated in the Contract Buyout Offer their old contract will be cancelled and neither the old contract nor the airtime tariff attached to it can be reinstated after this point. Any unused airtime allowances on tariffs attached to the old contract will be lost after an upgrade. This does not affect your statutory rights and you'll still have the right to change your mind about the Qualifying Contract as set out in the 'Change Your Mind' policy.
How to use your Handset Voucher Offer code
4.1. To apply the discount, set your upfront cost to at least match the value of your offer voucher.
4.2. The maximum value of the voucher code will be as specified in your email or SMS. No credit will be applied if the remaining value of your Outstanding Balance is less than the Handset Voucher Offer presented.
4.3. There is only one Handset Voucher Offer per Qualifying Contract. The end date for the Handset Voucher Offer, if any, is as set out in your email or SMS after which it will expire. Invalid or expired voucher codes will not be accepted.
4.4. Any voucher code must be presented at the point of purchase. Enter the voucher code in the "Got a Promo?" section or click "Apply Code" before you check out or call 202 to speak to an advisor to redeem the discount.
4.5. Once you have participated in the Handset Voucher Offer your old device plan will be cancelled and neither the old contract nor the airtime tariff attached to it can be reinstated after this point. This does not affect your statutory rights and you'll still have the right to change your mind about the Qualifying Contract as set out in the 'Change Your Mind' policy.
