4G Tariff Transfer Terms and Conditions
These terms apply in addition to your standard Pay Monthly Mobile Agreement ("Pay Monthly Mobile Agreement") which can be viewed at http://www.o2.co.uk/termsandconditions/mobile/our-latest-pay-monthly-mobile-agreement and our Pay Monthly Tariff Terms and Conditions which can be viewed at http://www.o2.co.uk/termsandconditions/mobile/our-latest-pay-monthly-tariff-terms. If there is any inconsistency between the Pay Monthly Mobile Agreement and these terms, or between our Pay Monthly Tariff Terms and these terms then these terms will prevail.
a) Transferring from an existing O2 non-4G contract to a 4G contract
If you are currently within the initial term of an O2 Pay Monthly 24 month On & On tariff, 24 month O2 Refresh tariff, or a 12 month Simplicity On & On tariff, you can transfer to an equivalent tariff to your existing one which can access our 4G services. This transfer is not available on a like for like basis on all packages for the tariffs named above. Some current non-4G packages are not available with 4G access. There may be other promotional offers from time to time which allow you to switch from a non-4G standard Pay Monthly tariff to an O2 Refresh 4G tariff. Details of these offers will be displayed on our website when they are available.
If your current package is not available with 4G access, you will need to move to a different package. This will have different tariff allowances (for minutes, texts and data) and may be higher priced than your current package.
If you transfer to a 4G tariff in accordance with these terms and conditions your minimum contract term will not be extended and will last for the same length as it was intended to under the original contract from which you transfer to a 4G contract.
In order to transfer your tariff to a 4G tariff you need to go to an O2 shop, call O2 customer services or visit My O2 at http://www.o2.co.uk/myo2 and sign up for a qualifying 4G tariff.
If you are transferring from a non-4G tariff to a 4G tariff, you will not be able to switch to a lower or same priced tariff. You can only transfer to a higher priced tariff.
O2 reserves the right to change or withdraw this transfer offer at any time (see paragraph 22 below).
b) Transferring from 4G to Non-4G
If you sign up to one of the 4G tariffs and you decide that you no longer want access to 4G services, you can choose to switch to a non-4G tariff. You will not be able to transfer from 4G to non-4G in the first 30 days of your 4G contract unless we provide any promotional offers to the contrary (details of which may be explained on this website from time to time).
In order to cancel your access to 4G you need to go to an O2 shop, call O2 customer services or visit My O2 at http://www.o2.co.uk/myo2 and confirm that you are cancelling your access to it.
If you decide to revert to a non-4G service the transfer to a non-4G service will take place the day before your next established bill date and you will be charged for the 4G services up to this date (unless we provide any promotional offers to the contrary, detail of which will be explained on this website from time to time).
You will only be able to transfer from one tariff to another once every 30 days (unless we provide any promotional offers to the contrary, details of which may be explained on this website from time to time). Therefore, if you have cancelled your 4G access , you will not be able to sign up again to the service for 30 days.
If you chose to transfer from a 4G tariff to a non-4G tariff you will no longer be able to access any 4G specific Bolt Ons or promotions which have become available to you as part of your 4G tariff and these will be removed from your account.
If you decide to transfer to a non-4G tariff you will have to revert to a current non-4G tariff. Non-4G tariffs may have changed since you formed your current contract. If you had a non-4G tariff before switching to 4G and your previous non-4G tariff is still available when you switch back to non-4G you can move back to the same tariff. If your previous non-4G tariff is no longer available when you switch back you will need to switch to a current non-4G tariff at the same price or above the price of your previous non-4G tariff.
If you did not have a tariff with O2 before you took your 4G tariff you will be able to transfer to a non-4G tariff under these rules but you can only transfer to the non-4G equivalent to the 4G tariff you were on (the same package or a greater package) without the access to 4G (and with the equivalent non-4G price for the package).
If you transfer to a non-4G tariff in accordance with these terms and conditions your minimum contract term will not be extended and will last for the same length as it was intended to under the original contract from which you transfer to a non-4G contract.
O2 reserves the right to change or withdraw this transfer offer at any time (see paragraph 22 below).
General
You should check our coverage checker at https://www.o2.co.uk/coveragechecker before signing up to our 4G services. This is an indication and prediction of outdoor coverage, but coverage may vary depending on time and location. Data reception and speeds may not be as good indoors or in a car. Radio-based mobile technologies can also be affected by local factors including buildings, trees and even weather conditions. The coverage checker is a guide and does not guarantee signal coverage. Check for live network updates in affected areas at http://status.o2.co.uk.
In order to access 4G services you will need a 4G ready phone, 4G services package, 4G sim card and you may need to do a software update on your phone if it does not have the software required to access 4G services. You're responsible for ensuring you have inserted your 4G sim and installing a 4G software update on your phone (if required). You must follow any instructions we send you about accessing our 4G network. Visit http://www.o2.co.uk/4g/setup for more details.
Once you have access to our 4G services, you will be able to access mobile internet data over our 4G network whenever you are in a 4G coverage area. When in our other mobile data network areas (for example Edge/GPRS/3G/HSPA areas) you will still be able to access non-4G data over these networks as usual.
Your data allowance (where applicable) will be used for all our different types of mobile data (for example Edge/GPRS/3G/HSPA areas) and will not differentiate between the types of mobile data you are using. The data allowance will not rollover from one month to another.
If any provision of these terms and conditions is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.
Subject to paragraph 8 of the Pay Monthly Mobile Agreement , we reserve the right to update these terms and conditions at any time. Any updates to these terms and conditions and/or the service will be explained at the top of this page and notified to you in accordance with the Pay Monthly Mobile Agreement. Please refer to the Pay Monthly Mobile Agreement for more details on our rights to vary and (if applicable) your rights to cancel.
These terms and conditions are governed by English law and are subject to the exclusive jurisdiction of the English courts, which both you and we submit to.
